How do you determine if you have claim?

It’s important that you not be at fault in the car collision or have received a citation for the collision. But if the other driver is at fault and you or a passenger was injured, you could have a legal claim to financial compensation.

If you can prove that 1) the person charged truly bears legal responsibility for your personal injury and 2) that the damages claimed truly reflect the extent of the injury or loss, you may have a personal injury case. Every personal injury case must address these two crucial elements, called (1) liability and (2) damages. These elements, depending on your State, may be established on one of three bases: negligence, strict liability, and intentional wrong.

Do You Have a Case?

MOTOR VEHICLE COLLISIONS: auto accidents, pedestrian accidents as well as truck and motorcycle accidents, can result in serious personal injury to those involved in the collision.

Every 10 seconds, someone in the United States is involved in a car accident, according to the National Highway Traffic Safety Administration. Injuries from traffic accidents are the leading cause of death for Americans from age 6 to age 33. According to national statistics, approximately 6,000,000 auto accidents occur each year, causing over 40,000 deaths and 3,000,000 injuries. The NHTSA compiled the following statistics regarding motor vehicle accidents:

  • 3,000 ,000 people were injured in motor vehicle accidents.
  • 40% of the fatalities were alcohol related.
  • 2,600 children under the age of 15 were killed in accidents.
  • 7,5000 young drivers (16-20) were involved in fatal crashes.
    • 3,000 motorcyclist were killed.
  • 4,7000 pedestrians were killed
  • Improper use of seat belts accounted for 63% of the fatalities.

18 WHEELER ACCIDENTS: A traffic accident involving a large commercial truck, such as an 18-Wheeler or semi truck, can have disastrous consequences. A typical fully loaded large commercial truck can weigh over 80,000 pounds, while an average passenger automobile weighs approximately 3,000 pounds. Because of the shear size of trucks, any collision between a commercial truck and another vehicle is likely to result in serious, even fatal, injuries. Commercial vehicles must abide by numerous federal and state regulations. The federal regulations can be found in the Federal Motor Carrier Safety Regulations (49 C.F.R. §§ 350-399). These regulations govern all vehicles engaged in interstate traffic and have been written to protect you. Semi-trucks and trailers are supposed to pass rigorous inspections and the drivers are supposed to be well-trained and have limits on how long they can drive without sleep. Yet many times when a tractor-trailer is involved in a wreck, an inspection uncovers problems with the rig – like worn-out brakes or brakes out of adjustment. The truck drivers involved in wrecks are often found to be under rested and in violation of safety regulations.

Trucking companies are sometimes pressed to find good drivers, so they put dangerous drivers behind the wheels. Other times the companies put scheduling demands on drivers that cannot be met without violating the laws that limit the number of hours a driver can be on duty. And sometimes trucking companies have been known to do the unthinkable – put a dangerous driver in a truck that can’t pass inspection and demand that the driver drive for more hours than allowed. These traumatic events can involve a single or multiple vehicles, pedestrians, intoxicated drivers, poor driving conditions, negligence, faulty equipment, and a variety of other causes.

WRONGFUL DEATH: when someone is killed as a result of another’s negligent actions, the family of the deceased often has grounds for a wrongful death claim.
